1. Custom Artwork Commissions

1.1 Commission Process (Step-by-Step)

  1. The Client submits a custom artwork request, including a creative brief outlining size, colours, style, and any specific requirements.
  2. Komak Studio (“the Artist”) reviews the brief and may request additional information or reference images if required.
  3. The Artist provides a formal quotation based on size, materials, complexity, and scope of work.
  4. The Client reviews and approves the quotation, concept direction, and any agreed design elements.

1.2 Concept Development

  • If the Client is unsure of the final direction, the Artist may request inspiration or reference imagery.
  • A charge of $500.00 nonrefundable is charged for concept development. Once approved the $500.00 charge will be credited to your main painting.
  • Concept sketches may be offered at the Artist’s discretion and are subject to an additional fee.
  • All sketches, concepts, and preliminary designs remain the intellectual property of the Artist unless paid for in full.
  • Unpaid concepts must not be copied, reproduced, or shared.

 

1.3 Approval and Deposit

  • A 50% non-refundable deposit is required to secure the commission and commence work.
  • Payment of the deposit confirms the Client’s acceptance of:
  • The quotation
  • The concept direction

1.4 Artistic Control and Expectations

  • The Client acknowledges that all commissioned works are original, one-off art pieces.
  • The final artwork is created in line with the approved brief; however, the outcome is subject to the Artist’s creative interpretation and vision.
  • The Client agrees that:
  • Minor variations in colour, texture, and composition are inherent in handmade artwork
  • The Artist retains full creative control throughout the process
  • The Client cannot reject or request changes to the final artwork based on personal preference or change of mind

1.5 Production Timeframe

  • Production will commence once the deposit has been received.
  • Estimated completion time is 3–12 weeks, depending on scale and complexity.
  • Timeframes are indicative only and may vary due to workload, materials, or artistic process.

1.6 Progress Updates and Changes

  • The Artist may provide progress updates at their discretion.
  • Once production has commenced:
  • No major design changes are permitted
  • Minor adjustments may be considered at the Artist’s discretion and may incur additional costs

1.7 Final Payment and Delivery

  • The remaining 50% balance must be paid in full prior to dispatch or collection.
  • Shipping, handling, and insurance (if required) are not included in the original quote and will be charged separately.
  • The artwork will not be released until full payment has been received.

1.8 Inclusions

Each original artwork includes:

  • A Certificate of Authenticity signed by the Artist
  • Paint colour swatches used in the artwork (where applicable)

2. Cancellations and Change of Mind

2.1 Cancellation by Client

  • If the Client cancels before work has commenced, the deposit remains non-refundable.
  • If the Client cancels after work has commenced, the Client:
  • Forfeits the deposit
  • May be liable for additional costs incurred up to the point of cancellation

2.2 Change of Mind

  • As all works are custom-made, change of mind is not accepted at any stage.
  • The Client agrees that once the concept and direction are approved:
  • The order is final
  • No refunds, exchanges, or cancellations will be provided

3. Refund Policy

  • All payments made to Komak Studio are final and non-refundable.
  • This includes deposits, progress payments, and final balances.
  • This policy reflects the allocation of:
  • Artist time
  • Materials
  • Design and production resources
  • No refunds will be issued based on dissatisfaction with the final artwork where it aligns with the approved brief.

4. Ownership and Intellectual Property

  • The Artist retains full copyright and intellectual property rights over all artworks, concepts, and designs.
  • The Client may not reproduce, distribute, or commercially exploit the artwork without written consent from the Artist.
  • The Artist reserves the right to photograph and use the artwork for portfolio, marketing, and promotional purposes.

 

5. General Terms

  • By proceeding with a commission, the Client confirms they have read, understood, and agreed to these Terms & Conditions.
  • These Terms may be updated at any time without prior notice.

TERMS AND CONDITIONS

KOMAK STUDIO – Artist Complete Concept Control Commission

1. Agreement Overview

By engaging the Artist under a “Complete Concept Control Commission,” the Client agrees that the Artist is granted full creative freedom and authority to design, interpret, and execute the commissioned artwork based on the initial brief provided.

The Artist is not required to seek ongoing approvals during the creative process unless otherwise agreed in writing.

2. Creative Control

Under this agreement:

  • The Artist retains full artistic and creative control over all concepts, composition, colour palette, materials, and final execution.
  • The Client acknowledges that the final artwork will be an interpretation of their vision, not a direct reproduction or fixed visual outcome.
  • Any reference images or briefs supplied are inspirational only.

3. Deposit & Payment Terms

  • A 65% non-refundable deposit is required to commence all commissioned work.
  • The remaining 35% balance is payable upon completion and prior to delivery or collection.
  • No work will be released until full payment has been received.

4. Change of Mind / Cancellation

  • Due to the custom and artistic nature of the work, all payments are final and non-refundable.
  • The Client may not cancel the commission once work has commenced.
  • Any change of mind by the Client at any stage does not entitle them to a refund of deposit or payments made.

5. Client Feedback & Revisions

  • Under Complete Concept Control, revisions are not included unless otherwise agreed in writing prior to commencement.
  • Any requested changes after the Artist has begun work may incur additional fees and may extend completion timelines.
  • The Artist reserves the right to decline changes that compromise the artistic integrity of the work.

6. Final Artwork Approval

  • By commissioning under this agreement, the Client agrees to accept the Artist’s final interpretation as the completed work.
  • Dissatisfaction based on personal preference, style interpretation, or change of expectation does not constitute grounds for refund or refusal of payment.

7. Copyright & Intellectual Property

  • The Artist retains full copyright and ownership of all original artwork unless otherwise agreed in writing.
  • The Artist reserves the right to:
  • Reproduce images of the artwork for portfolio, marketing, exhibitions, and promotional use.
  • The Client may not reproduce, copy, or commercially use the artwork without written permission from the Artist.

8. Production Timeframes

  • Timeframes provided are estimates only and may vary depending on creative process, drying times, materials, and workload.
  • The Artist will communicate reasonable updates but is not liable for delays outside their control.

 

9. Shipping, Delivery & Risk

10. Storage & Non-Collection

  • Completed works must be collected or delivered within an agreed timeframe.
  • Storage fees may apply if the artwork is not collected within a reasonable period after completion.

11. Acceptance of Terms

By paying the deposit, the Client confirms they:

  • Have read and understood these Terms & Conditions
  • Accept full creative control by the Artist
  • Agree to all payment obligations and non-refundable conditions outlined above
